**Educo Program Terms of Service**
**1. Introduction**
Welcome to Educo's Big Tech Program! These Terms of Service ("Terms") govern your access to and use of the Educo Program (referred to as "Program" or "Services"). By enrolling in or using the Program, you agree to comply with these Terms. Please read them carefully before proceeding. If you do not agree with any part of these Terms, you may not access or use the Program.
**2. Eligibility**
You must be at least 18 years old to enroll in the Educo Program. By enrolling, you represent and warrant that you meet this eligibility requirement.
**3. Access to the Program**
Upon successful enrollment, Educo grants you a non-exclusive, non-transferable, revocable license to access and use the Program for your personal or internal business purposes, subject to these Terms.
**4. Payment**
You agree to pay all fees associated with the Educo Program as outlined in the enrollment process. Fees are non-refundable unless otherwise specified in our Cancellation and Refund Policy.
**5. Content**
All content provided as part of the Educo Program, including but not limited to course materials, videos, and resources ("Content"), is the property of Educo or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on the Content without prior written consent from Educo.
**6. User Conduct**
You agree to use the Educo Program in compliance with all applicable laws and regulations. You must not engage in any activity that interferes with or disrupts the Program, servers, or networks connected to the Program.
**7. Intellectual Property**
All trademarks, service marks, logos, and trade names displayed on the Educo Program are the property of Educo or third-party licensors. You are not granted any right or license with respect to any of the foregoing.
**8. Disclaimer of Warranties**
The Educo Program is provided on an "as-is" and "as available" basis. Educo makes no warranties or representations about the accuracy or completeness of the Program's content or the suitability of the Program for any purpose.
**9. Limitation of Liability**
To the fullest extent permitted by law, Educo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from (a) your access to or use of or inability to access or use the Program; (b) any conduct or content of any third party on the Program.
**10. Governing Law and Jurisdiction**
These Terms shall be governed by and construed in accordance with the laws of Washington D.C., without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Program shall be subject to the exclusive jurisdiction of the courts located in Washington D.C.

**User Agreement/User License Agreement**
**Educo Program User Agreement**
This User Agreement ("Agreement") is a legal agreement between you ("User" or "You") and Educo, governing your access to and use of the Educo Program ("Program"). By enrolling in or using the Program, you agree to be bound by the terms and conditions of this Agreement. If you do not agree with any part of this Agreement, you may not access or use the Program.
**1. Grant of License**

**2. Program Access and Use**
You agree to access and use the Program only for lawful purposes and in accordance with this Agreement and all applicable laws and regulations. You are solely responsible for ensuring that your use of the Program complies with this Agreement.
**3. User Responsibilities**
You are responsible for maintaining the confidentiality of any login credentials associated with your Program account. You agree to notify Educo immediately of any unauthorized use of your account or any other breach of security.
**4. Intellectual Property**
All content provided as part of the Program, including but not limited to course materials, videos, and resources, is the property of Educo or its licensors and is protected by copyright and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works based on the Program content without prior written consent from Educo.
**5. Termination**
This Agreement is effective until terminated by either party. Educo may terminate this Agreement at any time without notice if you breach any provision of this Agreement. Upon termination, you must cease all use of the Program and destroy any copies of Program materials in your possession.
**6. Disclaimer of Warranties**
THE PROGRAM IS PROVIDED ON AN "AS-IS" AND "AS AVAILABLE" BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, EDUCO DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
**7. Limitation of Liability**
IN NO EVENT SHALL EDUCO BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH THIS AGREEMENT OR THE USE OF THE PROGRAM.
**8. Governing Law and Jurisdiction**
This Agreement shall be governed by and construed in accordance with the laws of Washington D.C., without regard to its conflict of law provisions. Any dispute arising out of or relating to this Agreement or the Program shall be subject to the exclusive jurisdiction of the courts located in Washington D.C..
**9. Entire Agreement**
This Agreement constitutes the entire agreement between you and Educo regarding the subject matter hereof, and supersedes all prior or contemporaneous understandings and agreements, whether oral or written.

**Code of Conduct**
**Educo Program Code of Conduct**
This Code of Conduct ("Code") sets forth the guidelines for acceptable behavior and interaction within the Educo Program ("Program"). By enrolling in or using the Program, you agree to abide by this Code. Failure to comply with this Code may result in the termination of your access to the Program.
**1. Respectful Behavior**
Treat all instructors, fellow learners, and Educo staff with respect and courtesy. Do not engage in any behavior that is disrespectful, discriminatory, or offensive.
**2. Professionalism**
Maintain a professional demeanor in all interactions within the Program. Refrain from using inappropriate language, engaging in harassment, or behaving in a manner that is unprofessional.
**3. Academic Integrity**
Adhere to principles of academic integrity and honesty. Do not engage in plagiarism, cheating, or any other form of academic misconduct.
**4. Compliance with Laws**
Ensure that your conduct within the Program complies with all applicable laws and regulations. Do not engage in any illegal activities or use the Program for unlawful purposes.
**5. Confidentiality**

**Cancellation and Refund Policy**

**1. Cancellation of Subscriptions**

Your subscription will remain active until the end of the current billing cycle, and you will not be charged for any subsequent billing periods.
**2. Refund Eligibility**
Refunds may be requested within 7 days of your initial enrollment in the Program. To be eligible for a refund, you must meet the following criteria:
- You have not accessed or completed any course materials or resources provided as part of the Program.
- Your request for a refund is submitted within the specified refund period.

**Dispute Resolution Clause**
**Educo Program Dispute Resolution Clause**
This Dispute Resolution Clause ("Clause") sets forth the procedures for resolving disputes between you ("User") and Educo ("Company") arising out of or related to the Educo Program ("Program"). By enrolling in or using the Program, you agree to comply with this Clause.
**1. Negotiation**
In the event of any dispute, the parties agree to first attempt to resolve the dispute informally by good faith negotiation. Either party may initiate negotiations by providing written notice to the other party describing the nature of the dispute and proposed resolution.
**2. Mediation**
If the dispute cannot be resolved through negotiation, the parties agree to submit the dispute to mediation administered by a mutually agreed-upon mediator. The parties shall share the costs of mediation equally. Mediation shall be conducted in accordance with the mediation rules and procedures agreed upon by the parties.
**3. Arbitration**
If mediation is unsuccessful in resolving the dispute, the parties agree to submit the dispute to binding arbitration in accordance with the rules and procedures of the Arbitration Organization. The arbitration shall be conducted by a single arbitrator appointed by mutual agreement of the parties or, failing such agreement, by the Arbitration Organization.

This Clause shall be governed by and construed in accordance with the laws of Washington D.C., without regard to its conflict of law provisions. Any dispute arising out of or relating to this Clause or the Program shall be subject to the exclusive jurisdiction of the courts located in Washington D.C..

The parties agree that any arbitration award rendered pursuant to this Clause shall be final and binding upon the parties, and judgment upon such award may be entered in any court of competent jurisdiction. The prevailing party in any dispute resolved through arbitration or litigation shall be entitled to recover its reasonable attorneys' fees and costs.
**6. Waiver of Class Action**
Both parties agree to waive any right to bring disputes on a class or representative basis. All disputes shall be resolved on an individual basis only.
**7. Severability**

**Governing Law Clause**
**Educo Program Governing Law Clause**
This Governing Law Clause ("Clause") determines the jurisdiction and laws that govern the agreement between you ("User") and Educo ("Company") regarding the Educo Program ("Program"). By enrolling in or using the Program, you agree to comply with this Clause.
**1. Jurisdiction**
Any dispute arising out of or related to the Program shall be subject to the exclusive jurisdiction of the courts located in Washington D.C.. The parties hereby consent to the personal jurisdiction of such courts for the purpose of resolving any such dispute.
**2. Applicable Law**
This Agreement and any dispute arising out of or related to it shall be governed by and construed in accordance with the laws of Washington D.C., without regard to its conflict of law provisions. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to this Agreement.
**3. Waiver of Forum**
The parties expressly waive any right to trial by jury and agree that any dispute shall be resolved exclusively in the courts specified in this Clause. The parties further waive any objection to the laying of venue in such courts and any claim that such forum is inconvenient.
**4. Severability**
If any provision of this Clause is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced by a valid and enforceable provision that most closely matches the intent of the original provision.
